On June 26, 2015, the U.S. Supreme Court ruled in the historic case of Obergefell that a ban on same-sex marriage is unconstitutional, and that gay couples can marry legally anywhere in the United States. If you are in a same-sex marriage, your union will be legally recognized everywhere in the United States, and you are entitled to the same state and federal benefits as married couples of the opposite sex.
However, these rules do not apply to unmarried couples who have formed either a domestic partnership or a civil union. If you are one of these two alternative marriage unions, no marriage benefits will apply to you under federal law, as the federal government does not recognize these same-sex relationships. For example, you cannot file a joint federal income tax return with your partner, even if your state allows you to jointly file state tax returns. And other federal benefits, such as Social Security Mortality Benefits and Cobra Continuity Insurance Coverage, may not apply.
