Same sex marriages prohibited

(a) Only a female may marry a male. Only a male may marry a female.

(b) A marriage between persons of the same gender is void in Indiana even if the marriage is lawful in the place where it is solemnized.

(Indiana Code section 31-11-1-1)

LITIGATION

Morrison v. Sadler, Ind. Court of Appeals No. 49A02-0305-CV-447

The Indiana Civil Liberties Union challenged the Indiana DOMA. The trial court granted the state’s motion to dismiss, and the plaintiffs appealed. On January 20, 2005, the Court of Appeals upheld the trial court's ruling that Indiana's DOMA is constitutional.
