These consolidated actions were filed to stop San Francisco
from continuing to issue marriage licenses to same-sex
couples, and to obtain a ruling that the licenses issued
were invalid. Now that the Supreme Court has stopped San
Francisco from issuing illegal marriage licenses, these
actions seek a declaration that California's marriage
statues are constitutional.

On March 11, 2004, the California Supreme Court ordered
a stay of San Francisco’s issuing of marriage licenses
to same-sex couples, stayed all proceedings in the consolidated
cases of Thomasson and Proposition 22,
and specifically permitted the filing of new lawsuits
challenging the constitutionality of California’s
DOMA. San Francisco and a number of same-sex couples immediately
filed these lawsuits, which have been consolidated. They
are currently coordinated under the supervision of one
judge, along with Tyler, Thomasson,
and Proposition 22.

Los Angeles, Case No. BS 088506
This lawsuit seeking marriage licenses for same-sex couples
is part of the coordinated proceedings.
Clinton v. State,
Case No. CGC 04-429548
Six same-sex couples who obtained marriage licenses from
San Francisco filed this lawsuit as a class action seeking
to have their licenses declared valid. This case was recently
included in the coordinated proceedings.
